
Prof Edward (Ted) Dove, Professor of Law at the School of Law and Criminology, published a case commentary in the academic journal Medical Law Review on the 22nd February entitled, ‘Prismall v Google UK Ltd [2024] EWCA Civ 1516: misuse of private information in the medical context’. Co-authored with Prof Mark Taylor (Melbourne Law School), Professors Dove and Taylor analyse the recent England and Wales Court of Appeal judgment in the case of Prismall v Google UK Ltd. They claim that Prismall holds significant weight in the development of the misuse of private information (MOPI) tort in England, and also holds significance due to judicial consideration of the circumstances giving rise to a reasonable expectation of privacy in medical records, the ‘threshold of seriousness’ that applies to MOPI claims, and the circumstances in which public sharing of private information might undermine a MOPI claim.
