Dr Aisling McMahon has recently published an article in the International and Comparative Law Quarterly (ICLQ). The article co-authored with Dr Bríd Ní Ghráinne (Judicial Studies Institute, Masaryk University) is entitled ‘Abortion in Northern Ireland and the European Convention on Human Rights: Reflections from the UK Supreme Court’. It examines the recent UK Supreme Court decision In the Matter of an Application by the Northern Ireland Human Rights Commission for Judicial Review (Northern Ireland) [2018] UKSC 27 on whether Northern Ireland’s near total ban on abortion is compatible with the European Convention of Human Rights (ECHR), critically assessing the UK Supreme Court’s treatment of international law in this case. The ICLQ is a leading international law journal on issues of public and private international law, comparative law, human rights and European law, and is published by Cambridge University Press.
Dr McMahon is a lecturer in Maynooth University Department of Law where she teaches a module on Contemporary issues in Medicine and the Law and Equity and Trusts.
Dr McMahon writes primarily on medical law, and also on the relationship between medical and patent law. Her work in the patent field includes a 2017 article examining the role of the morality provisions in the planned European unitary patent system. She also blogs about her research, including recent work on the impact of gene patenting on access to diagnostic testing as part of a broader British Academy funded project on the subject.”
